GunnAllen went under as a broker-dealer firm in 2010, but our firm prosecuted claims on behalf of its investor client against the financial advisor individually. The claims included causes of action for negligence; breach of fiduciary duty; misrepresentations and omissions; churning; suitability; violations of FINRA and NASD rules; and breach of contract and the covenant of good faith and fair dealing. A settlement was reached prior to having to file an arbitration claim before FINRA, resulting in an excellent outcome for the client.
